Additional Notice for California Consumers Effective January 1, 2020

This part of our Privacy Notice applies to consumers who reside in the State of California.

Personal Information We Collect about California Consumers

We describe the personal information we have collected from consumers in the twelve (12) months preceding the effective date of our Privacy Notice published on www.LBCExpress.com (See Privacy Notice for USA Customers for additional information).

The information we have obtained includes the following but not limited to:

1. Customer/Sender Information – Customer name, physical address, date of birth, e-mail address, telephone number, as well as sensitive information such ID, SSN information, credit card and/or bank account number, source of funds, purpose of transactions, and relationship to recipients

B.Receiver/Consignee Information – Receiver name, physical address, email address, and phone number, bank account information and Send N Swipe account information

C.Transaction Information – Type of Service/Product, Mode of Delivery, Payment mode – cash, check (Bank Information), debit and/or credit card (Debit Card or Credit Card Number), Remittance Amount in Dollars and Pesos and Exchange rate, Packing List information for Cargo products, transaction history and usage

D.Customer Service Information includes customer/shipper or receiver/consignee requests to facilitate claims, refunds, and other customer service requests 

E.Information that sender provides when registering for promotional programs

F.Information about sender’s transaction history and patterns, including your transmittal frequency, services used and their recipients

G.Information that we obtain to verify sender’s identity from third party identity verification services, electronic database services, and credit reporting agencies

H.Professional or employment-related information in the form of business contact information such as name, company name, physical address and email address and telephone or fax number

I.Agent information such as name, company name, physical address and email address and telephone or fax number, SSN and ID numbers, Date of Birth, etc.

J.Identifiers such as name, physical address, email address, username, password and other credentials used to access LBC products and services, social media handles, and, when they visit our websites, use our apps or interact with LBC-related tools, widgets or plug-ins, Internet Protocol address unique device identifier

K.Internet or other electronic network activity information, including, but not limited to, browsing history, search history, and information regarding a consumer’s interaction with LBC websites and mobile apps, and LBC advertisements that we display on LBC websites or mobile apps or on third party sites and apps

L.Geolocation data

M.Audio information from calls placed with customer service and accounting centers which may be recorded, and electronic information in the form of Internet or other electronic network activity information as described above

Disclosures of Personal Information for Monetary or Other Valuable Consideration or for Business Purposes

We do not sell your personal information to third parties in exchange for money. We do not participate in advertising, marketing and analytic programs from which we and third parties with whom we contract may derive value; such exchanges may constitute a “sale” under applicable law. While participating in the above programs, in the 12 months prior to the effective date of the Privacy Statement, we may have disclosed your personal information to a third party including:

Identifiers: contact information, for example your name, e-mail address, and telephone number; and

Internet and Other Electronic Network Activity Information: including the host from which you access the Internet, your IP address or device advertising ID, information about your device (such as device properties, settings, applications, storage and usage information), mobile application, browser and operating system software, social profile and network information, the date and time you access our websites and the address of the site from which you linked to our website when you visit us.

We have disclosed personal information in all or substantially all of the categories identified in this Additional Notice for California Resident Consumers for various business purposes. Your California Privacy Rights

If you are a California resident, you have the following rights. We will honor requests received to the extent required by applicable law and within the time provided by law.

Right to Access and Information regarding Personal Information.

You have the right to request that we disclose to you the categories and specific pieces of personal information we have collected about you. Specifically, you have the right to request that we disclose the following to you, in each case in the twelve-month period preceding your request:

A.the categories of personal information we have collected about you;

B.the categories of sources from which the personal information is collected;

C.our business or commercial purpose for collecting or selling personal information;

D.the categories of third parties with whom we share personal information;

E.the specific pieces of information we have collected about you;

F.the categories of personal information about you, if any, that we have disclosed for monetary or other valuable consideration and the categories of third parties to which we have disclosed the information, by category or categories of personal information for each third party to which we disclosed the personal information; and

G.the categories of personal information about you that we disclosed for a business purpose.

We will deliver personal information that we are required by law to disclose to you in the manner required by law within 45 days after receipt of a verifiable request, unless we notify you that we require additional time to respond, in which case we will respond within such additional period of time required by law. We may deliver the personal information to you through your account, if you maintain an account with LBC, or electronically or by mail at your option. If electronically, then we will deliver the information in a portable and, to the extent technically feasible, in a readily useable format that allows you to transmit the information from one entity to another without hindrance.

Right to Deletion of Personal Information.

You have the right to request that we delete Personal Information about you that we have collected from you.

Right to Opt Out.

We may not discriminate against you because of your exercise of any of the foregoing rights, or any other rights under the California Consumer Privacy Act, including by:

Denying you goods or services;A.Charging different prices or rates for goods or services, including through the use of discounts or other benefits or imposing penalties;B.Providing you a different level or quality of goods or services; orC.Suggesting that you will receive a different price or rate for goods or services or a different level or quality of goods or services.D.We may, however, charge different prices or rates, or provide a different level or quality of goods or services, if that difference is reasonably related to the value provided to LBC by your personal information.
